A guardianship is when the court orders someone other than a minor child’s parents to have custody and/or to manage the child(ren)’s property. A Guardianship is typically ordered when a child is not living with their biological parents.

A conservatorship is similar to a guardianship, only it deals with adults that are usually incapacitated or incompetent to make their own medical and/or financial decisions. The court will appoint a conservator who has fiduciary duties to manage and make decisions for the incompetent adult (“conservatee”).
